(Arkansas CSE) I started a contempt of court case with the ncp , for a modification 4 months ago , seeing is how the ncp is now making double income of what he was 7 yrs ago and has not turn in the increase of pay, Because it has taking CSE so 4 months and still do not have a court date, I have dug up the money and hired my old attorney that heard the case the first time for CS and Custody, we won then, But now CSE is saying Since the case is in legal, and ncp has an attorney, we can't stop the procedure, I want to close the case CSE and go forward with my attorney not CSE, But they wont let me close the case ....WHY NOT!!!!????? please someone answer this for me....BTW this county were this is taking place in AR is very "good ole boy system"
I should also say that when I did turn the case over for modification , it pissed the ncp off and he went and hired his lawyer and is now fighting for custody...
REALLY I WOULD LIKE TO KNOW WHAT STATE THAT WOULD BE.....CAUSE IN ARKANSAS THE COURT ORDER THAT I HAVE IN MY HAND SAYS IF HIS INCOME INCREASING OR DECREES BY 10% A YEAR THAT MY DEAR HE HAS TO REPORT....OR COULD BE IN CONTEMPT AND IM SURE YOU TAKE UP FOR GUYS THAT GET A BEAT DOWN FROM EX WIFE'S THAT SIT ON THERE BUTTS WANTING MORE MONEY....IN MY CASE ITS QUITE THE OPPOSITE ,

Well, CSE can't stop you from hiring your own attorney. Once that happens your attorney may be able to speed things up by forcing the court to adhere to statutory timelines. For example, filing a certain paper with X number of days from some event... or obtaining a ruling on a motion within a "reasonable period."

Your attorney won't be able to represent you before the court, but he could still help with the procedural aspects of the case.
